Yes, it is possible to get an uncontested divorce in Tennessee. An agreed, or uncontested divorce, is a lower-cost, lower-drama option for those couples who have come to a mutual understanding that their marriage is beyond repair.

If you and your spouse do not have children together who are under the age of 18, if you do not own property or businesses together or do not have retirement benefits to deal with, a divorce on  no-fault, or irreconcilable differences, grounds can be a fairly simple process. As long as one of you have lived in Tennessee for the past six months and you both agree on all of the issues including the division of personal items and alimony if that is an option.

We will caution you that even if in the beginning you and your spouse intend to file for an uncontested divorce, there is always the possibility that an unforeseen surprise may reveal itself causing you to consider contesting the previous agreement. It just makes sense to consult with an experienced Tennessee divorce attorney whether your divorce will be uncontested or contested. There is paperwork that you must file in the correct court at the right time. It would not make sense for you to try to handle even an uncontested divorce without the advice of counsel.

Whether you are working with an attorney or doing it yourself, you and your spouse will complete a marital dissolution agreement along with all of the other required forms. You can get more information about which forms you’ll need to fill out from this document from the Tennessee courts called: “How to Get An Agreed Divorce in Tennessee.”

Another issue to keep in mind is that if you hire a divorce attorney they represent you and your interests. They will not play the role of supporting the two of you in dissolving your marriage, so your spouse will have to retain counsel or be unrepresented.

Even when you are filing an uncontested divorce, it’s helpful to have a lawyer on your side who has more than 18 years of experience helping resolve their family law matters in Tennessee. We are happy  to answer your questions and ease your mind.
